SEC Division of Corporation Finance FAQ says maintenance of functional crypto networks generally does not constitute essential managerial efforts under the Howey test
According to reports,SEC the Division of Corporation Finance of the September 25 SEC released a crypto asset FAQ FAQ, explaining that maintenance and upgrades of functional networks, certain staking receipt tokens, and buybacks of non-security assets generally do not satisfy the Howey test’s key managerial efforts element under certain conditions.
