CFTC Market Oversight Staff: Prediction Market “Mention-Based” Contracts Are Susceptible to Manipulation
PANews reported on September 23, citing Decrypt, that staff in the CFTC’s market oversight division stated that prediction market contracts settled based on whether a named person says a specific word or phrase, attends an event, or interacts with another person should be presumed susceptible to manipulation. Settlement of these contracts depends on the specific actions of a named person, which staff consider to be “neither independently generated nor externally verifiable”; individuals with access to scripts or guest lists may possess material nonpublic information. The advisory opinion states that exchanges may rebut this presumption, but must provide more substantial evidence of monitoring and controls. The opinion is non-binding; previously, the CFTC fined a White House teleprompter operator USD 172,000 for trading contracts based on presidential mentions.
