CFTC Wins Fundsz crypto and precious-metals fraud case, with two defendants ordered to pay over 30000000 USD in fines
BlockBeats reports that October 1, the U.S. Commodity Futures Trading Commission (CFTC) said that the U.S. District Court for the Middle District of Florida entered a default judgment on Wednesday against Fundsz fraud case defendants Brian Early and Alisha Ann Kingrey, ordering them to pay more than 30000000 USD in fines.
The court found that, as board members and administrators of Fundsz entities’ Telegram groups, the two made material misrepresentations about expected returns, historical trading performance, and the risk of losses, and falsely claimed that investor funds could be traded through a “proprietary algorithm” and withdrawn with principal and interest. After learning of the CFTC investigation, they attempted to retract profit promotions and erase Fundsz’s social-media presence. On the same day, the court entered consent orders against two other defendants, Rene Larralde and Juan Pablo Valcarce.
Larralde died in 2023, and Rachel Larralde was substituted as a defendant and ordered to surrender “as is” possession and control of Larralde’s residence. Valcarce was permanently barred from engaging others to conduct cryptocurrency or precious-metals transactions on his behalf and from further violating the CFTC requirements.
